KAUKAUNA — Kaukauna police now have a new tool to crack down on reckless e-bike riders.
The new ordinance establishes what is called a “careless operation standard” that allows police officers to address behavior that creates unnecessary risk regardless of the specific device type.
According to the memo included in the April 8 Common Council meeting, the new ordinance defines the difference between e-bikes, e-scooters, e-motorcycles and other electric or motorized vehicles.

Electric bicycles, electric scooters and what are described as personal motorized mobility devices may be operated in the same style and manner as regular peddle bicycles (except for at the city’s skate park}.
Any electric bicycle modified to exceed 28 miles per hour or equipped with a motor exceeding 750 watts is not considered an electric bicycle and may be classified as an electric motorcycle.
Electric motorcycles, on the other hand, are considered motorcycles and shall require a valid Class M motorcycle license for operation on public roads. They have an electric motor with more than 750 watts and are capable of speeds in excess of 30 miles per hour.
The careless operation standard means that no person shall operate an e-bike or e-scooter on a street, sidewalk, alley or trail in the city carelessly or heedlessly in disregard of, or in danger to, the rights or safety of other’s property or person.
Penalties include:
- Under 16 years old:
a. First offense – $62
b. Second and subsequent offenses- $124 - Over 16 years old:
a. First offense – $124
b. Second and subsequent offenses – $248
