UPDATE — The Wisconsin Department of Justice says a person shot by an Appleton police officer Tuesday shot at police first and was pronounced dead after arriving at the hospital.

When police arrived, “they were confronted by an armed subject who shot at law enforcement,” a statement from the DOJ says. One officer fired back.

APPLETON – The state Justice Department is now handling the investigation into an incident where an Appleton police officer shot a suspect early Tuesday at an Appleton bar.

According to a news release, Appleton police were sent to the Maritime Tavern, 336 W. Wisconsin Avenue, about 1:30 a.m. for a weapons-involved complaint.

An initial responding Appleton police officer subsequently fired his duty weapon and a suspect was transported to a local hospital, according to a news release.

The condition of the person shot has not been released.

Pursuant to Wisconsin law, the Wisconsin Department of Justice-Department of Criminal Investigation is taking over the investigation.

The Appleton Police officer involved was not injured.
